
Terms & Conditions
1. Scope
These Terms and Conditions govern the relationship between Heiss Rentals (“Company”) and property owners (“Owner”).
The Company leases properties from owners and operates them as short-term rentals.
2. Business Model
The Company rents properties from the Owner under a long-term agreement and independently operates the property for short-term rental purposes.
The Company acts as tenant and operator, not as a property manager.
3. Lease Agreement
All specific terms regarding rent, duration and conditions are defined in a separate lease agreement between the Company and the Owner.
4. Operations
The Company is responsible for all short-term rental operations, including:
- Listing and pricing
- Guest communication
- Booking management
- Coordination of cleaning and maintenance
5. Owner Responsibilities
The Owner agrees to:
- Provide accurate information about the property
- Ensure the property complies with applicable legal requirements
- Allow the Company to use the property for short-term rental purposes (if permitted by law and building regulations)
6. Liability
The Company operates the property independently and assumes responsibility for its operations.
The Company is not liable for:
- legal restrictions on short-term rentals imposed by authorities
- changes in local regulations
- external factors affecting occupancy or revenue
Liability is limited to cases of gross negligence or intentional misconduct.
7. Use of Property
The Company may sublet the property for short-term stays in accordance with the agreed use.
The Company ensures professional handling of guests and operations.
8. Maintenance
The Company coordinates day-to-day maintenance.
Structural issues and major repairs remain the responsibility of the Owner, unless otherwise agreed.
9. Termination
Termination conditions are defined in the individual lease agreement.
10. Governing Law
These Terms are governed by the laws of Spain.
11. Final Provisions
If any provision of these Terms is invalid, the remaining provisions remain unaffected.
Any changes must be made in writing.
